The following are Hayzee Hydro’s Terms and Conditions which govern your use of our website. Our terms have been provided and approved by the company’s legal representatives. It is advised that you read the terms in full before you use this Website. If for any reason you do not accept these terms, please do not use this Website. Using the Website implies that you accept these terms. It is also worth understanding that we do occasionally update these terms and conditions, so it is advisable to refer back to them occasionally.
Terms and Conditions of Trade and Website Use These Terms and Conditions apply to all transactions on this site. Please read them carefully. They do not affect your statutory rights.
Delivery of Goods
Hayzee Hydro shall deliver the goods ordered to the delivery address which you supply at checkout. All delivery times quoted are estimates only based on availability, normal processing and delivery time. Title to the goods will pass to you on payment in full. Risk will pass to you on delivery.
You will have an opportunity to check and correct any input errors in your order up until you click the Submit Order button.
After you submit an order you will receive an Order Reference Number and details of the products you have ordered. We will send the same details to you in an e-mail. Acceptance of your order and the creation of a legally binding contract between us will only occur when we send you an e-mail, which will confirm your order and contain details of how we will deliver your products to you. (Alternatively, we may decline all or part of your order for any reason, in which case we will email to tell you so.)
We will tell you if your payment details cannot be authorised for any reason and may invite you to pay by another method or suggest that you visit us.
All prices and charges on this site are in UK pounds. They are inclusive of VAT, which is charged at the standard VAT rate.
The total cost of your order will be the price of the products you order, plus any applicable delivery charge. All these will be set out clearly in your Shopping Basket before you submit your order.
Prices, offers and products are subject to availability and may change before (but not after) we accept your order. If something becomes unavailable we may offer you an alternative or suggest that you visit us.
We try very hard to ensure that all information on this site is accurate. However, just occasionally, an error can occur. If we discover an error in the price or description of a product you have ordered, we will tell you and ask you whether you wish to continue with your order or cancel it.
Where we Deliver
Ubfortunately we only deliver to any address within the UK. All deliveries must be signed for (except items sent by post and which are small enough to be put through your letterbox). Please make sure you keep the receipt enclosed with your goods. Delivery times are calculated in working days - i.e. Monday to Friday inclusive (but excluding bank holidays). If you order after 1.00pm, please calculate your delivery time as if your order had been placed the following working day. – Please see our delivery page for more details Missing, Damaged or Incorrect Orders Any claim that any Goods or Services have been delivered damaged, are not of the correct quantity, or do not comply with their description, shall be notified by the Customer to Hayzee Hydro within 24 hours of the delivery time. We cannot accept responsibility for any errors/damages notified after that time. You may be asked to provide photos of damaged goods for us to make a claim. Any claim must contain full details of the claim including the reference numbers of any allegedly defective Goods or Services. Where possible, please provide photographic evidence of any damaged goods. Email all photographs to firstname.lastname@example.org as soon as you can. The Company shall be afforded reasonable opportunity and facilities to investigate any claims made under this condition and the Customer shall if so requested in writing by the Company promptly return any Goods or Services the subject of any claim and any packing materials securely packed and paid to the Company for examination. The Company shall have no liability with regard to any claim in respect of which the Customer has not complied with the claims procedures in these conditions.
Guarantee and Returns Policy
Our aim is to make sure you are completely satisfied - if you are not satisfied with any item that you have purchased from us, providing it has not been opened or damaged, you may return the item within 7 days of receipt for a full refund of the purchase price, minus the shipping & handling fees. In this case the customer will be responsible for all shipping costs incurred when returning the item. You shall be responsible for the cost of returning goods for refund or exchange, except in cases of faulty, damaged or wrongly supplied goods. Hayzee Hydro recommends that you use registered post or recorded delivery when returning goods and that you package your items appropriately to avoid damage in transit. Hayzee Hydro shall use reasonable efforts to replace damaged or defective goods but if replacement is not possible, or if an order is cancelled for any other reason under these Terms, Hayzee Hydro only obligation is to refund the full amount paid by you. All Items must be returned unused in a re-sellable condition, including packaging. If returned items do not comply with these conditions then they will be subject to a 35% handling charge together with collection charges where applicable.
We do not accept:
Any grow tents that have been removed from their original packaging. Any sealed goods such as nutrient truncheons, pH meters, etc cannot be returned once the seal has been broken unless found to be faulty. We do not accept back nutrients, additives or grow media in store. If the customer has purchased any kit from us, whether it is a lighting system or carbon filter, the customer needs to make sure that all parts of the kits are returned. It is the responsibility of the customer to ensure that when they are ordering by telephone the sizes, models and choice of products are the correct items. Any costs incurred by us in changing these products will be charged to the customer.
Hayzee Hydro own the copyright, trademarks and all other intellectual property rights in all material and content on this website, which you may use, download, copy, publish, transmit or otherwise make available by any other means only for your own personal, non-commercial use. Any other use or reproduction of the material or content is strictly prohibited. You may not create any link to this website without our prior written consent, nor may you restrict or inhibit the use or enjoyment of it by anyone else.

Governing Law and Jurisdiction
These Terms and Conditions shall in all respects be construed and interpreted in accordance with the Law of Contract in England and Wales notwithstanding the effect of the law of the European Union. Where the Company and the Customer have contracted to perform in England and Wales or Scotland the competent Court of Jurisdiction shall be the High Court of England and Wales. Where the Customer is resident in the European Union or EFTA, the Company may at its absolute discretion nominate the Court of the Customer’s member state to be the Court of competent jurisdiction under the Brussels Convention. Where the Customer is resident elsewhere the Company shall possess the absolute discretion as to the competent court or jurisdiction.
Invalidity of Terms and Conditions
Under no circumstances shall the Company have any liability of whatever kind for: Any defects resulting from wear and tear, accident, improper use by the Customer or use by the Customer except in accordance with the instructions or advice of the Company or the manufacturer of any Goods or Services or Goods or Services or neglect or from any instructions or materials provided by the CustomerAny Goods or Services which have been adjusted, modified or repaired except by the CompanyThe suitability of any Goods or Services for any particular purpose or use under specific conditions whether or not the purpose or conditions were known or communicated to the CompanyAny substitution by the Company of any materials or components not forming part of any specification of the Goods or services agreed in writing by the CompanyAny descriptions, illustrations, specifications, figures as to performance, drawings and particulars of weights and dimensions submitted by the Company contained in the Company’s catalogues, price lists or elsewhere since they are merely intended to represent a general idea of the Goods or Services and not to form part of the contract or to be treated as representationsAny technical information, recommendations, statements or advice furnished by the Company its servants or agents not given in writing in response to a specific written request from the Customer before the Contract is made, orAny variations in the quantities or dimension of any Goods or Services or changes of their specifications or substitution of any materials or components; if the variation or substitution does not materially effect the characteristics of the Goods or services, and the substituted materials or components are of a quality equal or superior to those originally specified. If for any reason part of these terms and conditions are unenforceable, the validity of the remaining terms and conditions shall not be affected.
